Diagnostic errors are the most common type of error that occurs in the outpatient setting, whether it be the emergency room or in your doctor’s office. According to the Institute of Medicine, at least 5 percent of all U.S. adults who receive outpatient care each year will experience a diagnostic error, meaning 12 million patients are misdiagnosed annually. The most common misdiagnoses are cancer, infections, fractures, and myocardial infarctions (heart attacks). If you or a loved one has been misdiagnosed, contact Shawn today for a free consultation regarding your potential case.

A recent study found more than 4,000 preventable surgical errors occur per year. In a recent analysis, each week surgeons leave a foreign object like a sponge or towel inside a patient’s body after an operation (39 times), perform the wrong procedure on a patient (20 times), or operate on the wrong body site (20 times). If you are the victim of a botched surgery, contact Shawn today for a free consultation regarding your potential case.

There are few things more sacred than a health care provider’s duty to protect your private health information. In fact, both federal and state law recognize the importance of maintaining the confidentiality of your medical records. If a health care provider violates patient confidentiality and discloses your private health information without your permission, you may have a claim for medical malpractice against the health care provider. If you believe your confidential health information has been disclosed without your permission, contact Shawn today for a free consultation regarding your potential case.

Have you been hit by someone who was texting or using his phone while driving? You are not alone. The National Safety Council reports 1 out of every 4 car accidents is caused by the driver being distracted by using his or her phone. Have you been injured by a drunk driver? If you’re a cyclist, has a motorist run you off the road or collided with your bike? Have you been injured in a motor vehicle accident through no fault of your own? If you were sitting at a red light and rear-ended, T-boned because a driver ran or ignored a stop sign, injured by a drunk driver, or side-swiped or run off the road because a motorist was texting while driving, you may deserve compensation for your medical bills, as well as pain and suffering due to the accident. Contact Shawn today for a free consultation regarding your potential case.

The National Floor Institute report that falls account for over 8 million hospital emergency room visits, representing the leading cause of visits (21.3%). Slips and falls account for over 1 million visits to hospitals annually. While a land owner or business owner owes a duty to others to maintain the premises in a reasonably safe state, not all falls, trips, or slips result in lawsuits. Shawn has experience in handling these types of difficult legal cases. If you have been injured due to a fall, contact Shawn today for a free consultation regarding your potential case.

A congressional study found 30 percent of nursing homes throughout the United States have been cited for abuse - that means nearly 1 in 3 residents at a nursing home has suffered abuse or neglect. Sadly, South Carolina was recently rated at the 2nd worst state in protecting our elderly residents. Common problems that occur in long-term care facilities include untreated bedsores, inadequate medical care, malnutrition, dehydration, preventable accidents, and inadequate sanitation and hygiene. Other forms of abuse and neglect include infection (particularly from bed sores), falls, verbal abuse, cursing at residents, improper transfers, and inadequate staffing to properly care for residents. If your mom, your dad, your husband, or your wife has experienced neglect or abuse at the hands of those entrusted to provide your loved one with daily care, contact Shawn today for a free consultation regarding your potential case.
